Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Vikorus LLC (“Vikorus,” “we,” “us,” or “our”) and govern your access to and use of the Vikorus website at vikorus.com, our mobile and desktop applications, and any related content and services (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Vikorus is an independent software studio. Our apps are informational and productivity tools — calculators, trackers, reference guides, live-data viewers, and games. We may add, change, suspend, or discontinue any part of the Services at any time without notice or liability.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services, and old enough to form a binding contract. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for it.

3. Informational only — not professional advice

Our apps, including any calculators, estimates, projections, pay and benefits figures, financial or retirement tools, and reference material, are provided for general informational purposes only. They are estimates and educational aids, not professional advice, and are not a substitute for guidance from a qualified financial, tax, legal, medical, accounting, aviation, or other professional, or from an official source. Amounts, rates, rules, schedules, calculations, results, and third-party data may be inaccurate, incomplete, out of date, or unsuitable for your situation, and may contain errors or omissions. Always verify important information with the relevant official authority (for example, the VA, DFAS, OPM, the TSP, the FAA, or your finance office) before relying on it. You use the Services and any information they provide entirely at your own risk. You are solely responsible for any decision you make or action you take (or do not take) based on the Services, and to the maximum extent permitted by law Vikorus is not responsible or liable for any outcome, loss, or damage resulting from any inaccurate, incomplete, outdated, or unsuitable information, calculation, estimate, or result.

3a. No reliance and assumption of risk

The Services do not create any professional, advisory, fiduciary, or special relationship between you and Vikorus, and no such relationship should be inferred. You agree not to rely on the Services as your sole basis for any financial, legal, tax, benefits, medical, safety, navigational, or other decision, and you knowingly and voluntarily assume all risks associated with your use of the Services and any reliance you place on them.

4. License to use the Services

Subject to these Terms, Vikorus grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own lawful, non-commercial use. All rights not expressly granted are reserved.

5. App stores

Our apps are distributed through third-party platforms, including the Apple App Store and Google Play. Your use of an app is also subject to that platform’s terms. You acknowledge that these Terms are between you and Vikorus, not with Apple or Google, and that those platforms are not responsible for the apps or for support. To the extent applicable, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

6. Purchases, subscriptions, and refunds

Some apps offer one-time purchases or auto-renewing subscriptions. All purchases are processed by the app store, not by Vikorus. Subscriptions renew automatically until cancelled through your app store account settings, and pricing and availability may vary by region and change over time. Except where required by law, all purchases are final and refunds are handled solely by Apple or Google under their policies — Vikorus does not process refunds.

7. Acceptable use

You agree not to, and not to attempt to:

  • use the Services unlawfully or in violation of these Terms;
  • copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Services except as permitted by law;
  • interfere with, disrupt, overload, or gain unauthorized access to the Services or their systems;
  • use automated means to scrape or harvest data except as expressly permitted; or
  • use the Services to infringe others’ rights or to transmit harmful or unlawful content.

8. Intellectual property

The Services, including all software, text, designs, logos, and the Vikorus name and marks, are owned by Vikorus or its licensors and are protected by intellectual-property laws. Third-party names and marks are the property of their respective owners and are used for identification only; their use does not imply endorsement.

9. Third-party content and links

The Services may display or link to third-party data, content, or websites. We do not control and are not responsible for third-party materials, and we make no warranties about their accuracy or availability. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. VIKORUS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE, OR THAT ANY RESULT OR CALCULATION WILL BE CORRECT OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIKORUS LLC, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES OR FROM ANY RELIANCE ON ANY CALCULATION, ESTIMATE, OR INFORMATION PROVIDED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIM THAT INFORMATION, DATA, A RATE, A SCHEDULE, A CALCULATION, OR A RESULT IN ANY APP OR ON THE WEBSITE WAS INACCURATE, INCOMPLETE, OUTDATED, OR UNSUITABLE, AND ANY LOSS OR DAMAGE ALLEGED TO ARISE FROM YOUR RELIANCE ON IT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF VIKORUS FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VIKORUS FOR THE RELEVANT APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN YOU AND VIKORUS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vikorus and its owners, members, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction, except where applicable law requires otherwise. To the extent permitted by law, you and Vikorus waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as part of any class or representative action.

15. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted, and the “Last updated” date above reflects the latest version. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Vikorus regarding the Services and supersede any prior agreements.
